We will choose the ceremony start time we think it will be best for you, charge your card the retainer, and send you en electronic contract for your signature. After you sign the contract electronically, you will receive a confirmation with more details and information on what your next steps will be.
SERVICE TERMS – MUST READ
About us: Our Company’s legal name is Beach Wedding in Florida, LLC. Beach Weddings in Florida, LLC is owned and operated by Negroni Photographers, LLC. Any reference to “us”, “we”, “our”, “BWIF”, and “Beach Weddings in Florida”, a includes Beach Wedding in Florida, LLC, its subcontractors, affiliates and suppliers. Any reference to “couple”, “you” or “customer” includes bride, groom, family members, friends or any person accessing and using this web site to reserve any service offered by Beach Weddings In Florida, LLC.
Retainers: A Nonrefundable Retainer is required to reserve any ceremony package when you reserve our services for a date one month or more away from the date of your reservation. Please check the package description for retainer amount. Although the Retainer payment is discounted from the total package price, this money is not a payment for future service but is immediate compensation for holding our services just for you, for a specific date and time. Retainer payment may include your initial consultation, access to private and privileged information about our services and the time spend on planning and assisting with your reservation. In summary, when you pay your Retainer, this payment covers the services provided to you before the actual ceremony service.
Balances: The balance (total minus Retainer) is due one month prior your ceremony. Reservations with a pending balance beyond the due date are subject to cancellation without notice and any monies paid towards the reservation are forfeited and not refundable.
Beach Ceremony Times: Beach ceremonies are held about an hour before sunset, subject to availability. We do NOT arrange sunrise, morning or early-afternoon weddings. Our coordinator will choose a time we believe works best for you after a retainer is received.
Changes to our packages: Our prices and packages’ content are subject to change anytime without notice. Couples that reserve NOW are subject to CURRENT package descriptions and CURRENT prices and package description. After you reserve and pay your Retainer, future changes DO NOT affect you.
Postponements, Reschedules and Cancellations – Retainers are used to retain our services for YOU and turn everyone else away for a specif date and time. Retainers are NOT refundable and are NOT transferable to another date OR couple under ANY circumstances; no exceptions. If you cancel your reservation, you do not get your retainer back. If you reschedule your wedding for a different date than the date you contracted, you will have to sign a new agreement and submit a new retainer.
Officiant: We cannot guarantee a specific Officiant, gender or religious denomination. Your Officiant will be assigned based on availability and is subject to change anytime if an emergency arises and no refunds, partial refunds or compensation should be expected.
PHOTOGRAPHY & VIDEOGRAPHY AGREEMENT:
- Exclusivity: When you reserve our services, it is understood that Negroni Photographers, LLC is the exclusive photographer and/or Videographer for your event. You cannot bring an outside professional photographer or videographer without our previous approval regardless of relation.
- Videography: Photography and videography are sold separate. Packages with photography included DO NOT include videography; these are TWO different services! Ceremony videography is available from $375.00 and up. Basic fee includes videographer on site for up to one hour, a wireless microphone on the Officiant or groom, and two edited DVD’s. Video editing is subject to the videographer’s discretion. You may request that we add a song of your choice to the video, however, you must send us an email with the MP3 of the song of your choice no later than two (2) weeks after your ceremony. If your requested music is not received by the due date, the music used on the video it’s subject to the videographer’s discretion. In addition, video footage is taken with only one camera. Additional cameras and external lighting is NOT included with the service, therefore, ceremony footage will be taken from a single angle and video’s exposure is subject to external lighting conditions.
- What’s Included With Your Photography: Photography included with our packages is ceremony photography only; the photographer will start taking pictures when the ceremony begins until the ceremony ends. If time and weather permits, he/she will also take immediate family and bridal party photos if applicable followed by bride and groom only photos. Photography DOES NOT include reception coverage or a second location. ALL photography is taken at the ceremony location and must be completed within one (1) hour to the photographer’s discretion unless is noted otherwise on your package description. Photography included with the elopement packages starts when the ceremony starts, followed by a short bride and groom session around the venue subject to weather conditions.
- Photography & Videography Final Product:
- The couple will receive an email with a one-time download link to receive their final high-resolution images.
- The Photographer and videographer reserve the right to select, keep, edit and release only those photographs and video footage that meet his or her artistic standards. Video will be edited to the videographer’s discretion. Your photos may contain a mixture of color, black and white, and selective color images, subject to the photographer’s discretion.
- The photographer and videographer keeps for a limited amount of time, subject to his or her discretion, exactly the same images and video footage given to the couple, therefore, a different version of a photo or video received will not be available. Raw and unedited files and footage are not available for sale and are destroyed after the final work is completed.
- Client accepts all responsibility for archiving and protecting the photographs and video disks. Photographer and videographer are not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided.
- When To Expect Your Photos: Although we try to complete your photos and video as soon as possible, some times it will take us up to two months after the ceremony to send your final photos and/or video, depending on our work schedule. If you are planning a reception or event with your photos and video, we strongly suggest you do not schedule your event any sooner than two months after your ceremony.
- Responsibilities: Photographer does not permanently archive image files. Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is Client’s responsibility to make sure that digital files are copied to new media as required.
- Liability:
- Photography and videography work is sold “as is”. There are no refunds or partial refunds if you are not satisfied with your photos and/or video. Although we strive for high quality work, due to elements out of our control, such as weather, guests’ cooperation, natural lighting, etc., it is not always possible.
- In the unlikely event of equipment malfunction or any other situation that will prevent us from delivering NO photos and/or NO video footage at all, our liability and compensation is limited to a refund of monies paid for the photography and videography portion of your package only. If you received videography as a complimentary service, no compensation should be expected in the event BWIF or it’s subcontractors are not able to deliver the final product.
- If the Photographer is unable to perform any or all of the duties herein for any reason,including but not limited to, fire, transportation problems, acts of nature, accident, illness, or technical problems, and if she cannot provide another competent professional, all money received by the Photographer, minus expenses, will be returned to Client, and the Photographer shall have no further liability with respect to this agreement. This limitation of liability also applies to any loss/damage of photographs or failure to deliver photographs for any reason. Liability for a partial loss of photographs shall be pro-rated based on the percentage of total. The sole remedy for any actions or claims shall be limited to a refund whose total amount cannot exceed the total monies paid by Client under this Agreement during the time preceding the date on which such liability arises.
- Our staff WILL NOT operate other people’s electronic equipment including but not limited to cameras, radios, video cameras, etc.; Please be respectful to our staff and don’t ask.
- Copyrights:
- Photography or videography taken by Beach Weddings in Florida, Negroni Photographers, its employees, and subcontractors becomes property of Beach Weddings in Florida and Negroni Photographers and it can be used to our discretion for marketing and promotion purposes, under the appropriate laws and regulations.
- Photography and video taken by Beach Weddings in Florida, Negroni Photographers, its employees, and subcontractors are protected by United States Copyright Laws (USC Title 17). Client hereby waives any claims for ownership, income, editorial control and use of the images. Violators of this federal law will be subject to its civil and criminal penalties.
- Release: The Photographer hereby grants permission to the bride and groom and his/her/their photo laboratory of choice to make reproductions of their digital images in any size or quantity for personal use only. This release does not allow the photos to be altered, sold or published. Client further agrees not to supply images to any third parties (including vendors associated with the wedding or album designers).
- Model Release: This contract serves as a model release giving the Photographer the irrevocable right to use the photographs in all forms and in all media and in all manners, without any restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. The Photographer can grant use of the images to third parties and all compensation for use and credit for the images remain the property of Negroni Photographers. Client waives any right to inspect or approve the photograph(s), finished version(s) incorporating the photograph(s), or the use to which it may be applied, including written copy that may be created and appear in connection therewith. This release is binding on the Client, their legal representatives, heirs, and assigns.
- Photography Upgrades:
- Extended photographer’s time may be available for your date for an added fee, subject to availability. We cannot guarantee the photographer’s availability for extended coverage even if you have a package booked with us. If you plan on upgrading your photography, please inquire availability before you reserve your beach wedding package and secure the service as soon as possible if it’s available.
- Extended photographer’s time is continuous and it includes the photographer’s travel-time between locations, the time he or she needs to arrange equipment at each location, as well as the actual photography coverage.
- If you extend your photography coverage to include reception or after-ceremony celebrations, please provide the photographers with a small meal at the same location.
Beach Locations:
- If you don’t have a suitable beach ceremony location arrange at the time of the booking, we will make a suggestion for a suitable public beach location . You will receive more details as soon as your reservation is confirmed. Couples that prefer to arrange a beach location on their own must notify BWIF about their request BEFORE submitting their paid reservation. In addition, our team must be provided with paid parking spaces at your location; street or metered parking is NOT acceptable.
- There is an additional permit fee to hold weddings on Clearwater Beach and the Sarasota Beach area. BWIF will request the permit on your behalf and send you details on how to submit your payment directly to the vendor OR send you the details on how to secure your permit. A beach location is NOT secured until the beach permit fee payment is received. You are responsible for securing the beach location by making your payment as soon as is requested.
- Please be aware that most outdoor locations we service are open to the public and are not private venues. There are NO private beaches in Florida. We cannot guarantee the availability of public parking, handicap access or the state of the beaches (i.e. crowds, tides, seaweed, etc).
- We are NOT responsible if the State, City or County changes their rules, policies or operating hours. Our team will try our best to accommodate in the event a change occurs; however, all changes are subject to our work schedule and availability.
Late Start: It is not acceptable to arrive late; it is rude to your vendors. Your ceremony is scheduled for a specific start time and our team expects to start working right on time. If your ceremony starts late, we will shorten the length of your ceremony to the scheduled end time. Any ceremony that has not begun within 30 minutes will be considered a No-Show and will be automatically cancelled.
Acts of Nature:
- In case of weather-related emergencies (hurricanes, tropical storms, etc), you will be given the opportunity to postpone your event for a later date and/or time subject to our calendar availability.
- Beach Weddings in Florida, LLC reserves the right to postpone or cancel your ceremony in the event that a Tropical Storm or Hurricane Watch OR Warning is placed anywhere in the State of Florida and/or if we feel that weather conditions are potentially hazardous for our team, for YOU and YOUR guests. Our team will NOT drive to perform a ceremony with
- There are NO REFUNDS and we are NOT liable for expenses, damages and/or money lost due to Inclement weather, (hurricanes, tornadoes, high winds, etc.) area evacuation, emergencies, duty or other calamity that may result in cancellation/ postponement of the event.
- We highly recommend you purchase wedding insurance as an inexpensive alternative to recover your investment in case of permanent cancellation due to unavoidable events.
Rain and weather policy for beach ceremonies:
- You MUST have an indoor backup location within five miles from the ceremony site.
- If the day of your wedding there is forecast of 40% or more chance of rain on your wedding day and/or time, we will setup at your backup location automatically.
- Our team will NOT arrange decorations under the rain.
- Our ceremony vendors will NOT perform services under the rain.
- If it rains during your ceremony, we will try to complete our services to that point. We will NOT perform our services under the rain. Our team will NOT follow you to a second location with the exception of elopements.
- We do not issue refunds if you cancel your wedding, if we cannot proceed with our services as scheduled due to inclement weather.
- It is highly recommended you purchase wedding insurance (www.WedSafe.com) when planning a wedding.
Possible Additional Fees:
- Beach permit fees are NEVER included with ANY of our packages/services unless is written under the package’s description. We are NOT responsible if the State, City or County decides to charge permit fees after you have secure your package with us. You are still in responsible for any beach permit fees if they are applicable at the time of your wedding.
- Private parking or hotel parking fees are not included with our services and must be paid before the ceremony starts. If there is a parking fee and you want us to perform the ceremony there, complimentary parking spaces must be arranged for our team.
Rehearsal requests: Rehearsals are NOT included with any package. They may be available for an additional fee and are subject to availability. Reserving a wedding package does not guarantee that we have availability for a rehearsal as well. All rehearsals are scheduled during the week (Monday through Thursday) around midday, subject to our calendar availability.
Final Work On Hold: We reserve the right to hold pending work including photography if there is a balance due including additional fees (late fees, travel fees, exceeded attendance, etc.) until payment is received.
Tossing on the ground: NO silk rose petals or confetti! You may use FRESH rose petals on the beach (NOT allowed at park or garden locations). Other locations you may use bubbles instead.
Beach and safety rules:
- NO FIREWORKS
- NO ALCOHOLIC BEVERAGES
- NO FOOD
- NO BEVERAGES
- NO GLASS CONTAINERS
- NO PETS EXCEPT FOR BEACH LOCATIONS WHERE PETS ARE ALLOWED. CONTACT US BEFORE YOU BOOK FOR DETAILS.
Beach Decorations:
- Decorated aisle way fees do NOT include ownership of the decorations, flowers, or greenery. You cannot take the greenery or flowers with you. All floral arrangements and decorations, except for bridal bouquets and boutonnieres, are property of BWIF.
- You cannot bring, setup or add your own decorations, tables, chairs or equipment while we are under contract.
- BWIF reserves the right to replace any decorations, vendors, photographer, musician and services with a comparable substitute to accommodate last minute emergencies, no shows and unexpected situations and no compensation or refund should be expected.
Liability:
- The bride and groom assume full liability for any property damage done to our equipment by themselves, their attendants and/or their guests before, during or after the ceremony, and agree to reimburse property owner for such damage.
- The bride and groom releases Beach Weddings in Florida and its owners, contractors and employees and assume full liability for any personal damages done to themselves, third-party vendors or any guests before, during or after the ceremony.
BRIDEZILLA CLAUSE:
- In the event that either bride, groom, bride’s family, friends, guests, parents or anyone involved in the planning process become unreasonable or hard to work with, Beach Weddings in Florida reserves the right to terminate this agreement anytime. If Beach Weddings in Florida, LLC decides to terminate this agreement without the customer’s initial request, BWIF’s liability is limited to a full refund of fees already received from the customer minus nonrefundable retainer, venue fees if applicable, marriage license fee if applicable and any third-party or vendor payment. Approved refunds are always sent no later than 90 days after the cancellation date.
Legal Responsibilities:
- Beach Weddings in Florida reserves the right to sell or transfer this contract to another wedding vendor anytime for any reason.
- Legal Questions – We are not licensed attorneys, therefore, cannot provide information about the legality of your Florida Marriage in the State or Country you reside. If you have any legal questions about getting married in Florida, please contact your local Clerk’s office, Courthouse or seek legal advice through a licensed attorney. This agreement cannot be changed or modified without Beach Weddings in Florida written consent.
- When you submit your Retainer payment, you are confirming that you have read, understood and fully agreed with the Service Terms and Conditions Listed on this agreement.
Everything Else:
- Garden Ceremony Packages – The calendar below shows OUR TEAM’S availability – NOT the venue’s availability. All reservations request are subject to venue’s availability. If the venue is NOT available for your requested date and/or time, we will NOT charge your credit card and you will be notified immediately.
- When you make your retainer payment, you are confirming that you have read our Service Agreement and you agree with our Service terms and conditions.
